IT IS IMPORTANT THAT YOU CAREFULLY READ ALL TERMS OF THIS NOTICE AS IT CONSTITUTES PART OF YOUR CONTRACT FOR YOUR VACATION AND ANY RELATED SERVICES. FURTHER IT CONTAINS IMPORTANT LIMITATIONS ON YOUR RIGHTS. IT LIMITS YOUR RIGHT TO SUE. THIS AGREEMENT REQUIRES THE USE OF ARBITRATION FOR CERTAIN DISPUTES AND WAVES ANY RIGHT TO TRIAL BY JURY TO RESOLVE THOSE DISPUTES. PLEASE CALL US IMMEDIATELY IF YOU HAVE ANY QUESTIONS.
Please thoroughly review these terms and conditions of EGM Marketing, Inc. and Vacation Superstore Network, Inc., herein jointly referred to as AACT. The booking passenger is the only recipient of this booking receipt and terms and conditions – multiple receipts will not be issued. It is the sole responsibility of the addressee to inform all other parties either listed or traveling on the booked cruise of the contents of these terms and conditions. Purchase or use of travel arrangements, whether or not this document is signed by the Passenger, shall constitute the agreement by Passenger, on behalf of himself and all other persons traveling under his travel arrangements (including any accompanying minors or other persons for whom travel arrangements was purchased), to be bound by the terms and conditions of this document. The booking passenger, by making payment, acknowledges that they have been advised of, reviewed, and hereby accept these terms and conditions and contract for travel related services.
BOOKING ACCURACY/LEGAL NAMES: Passenger is required to immediately verify all details of their confirmation i.e. passenger name(s), postal and email address(es), date(s) of birth, tour departure date, cruise/tour itinerary, cabin category and assignment, pricing, airfare, and port transfer(s), on your booking receipt, as well as the cruise line's current brochure and/or cruise line website for accuracy. Passenger is also required to verify notation of any/all qualifying bonus gifts/items, shipboard spending credits, and included travel protection; if applicable, on your confirmation. AACT will not honor any claim for items not documented as included in your confirmation. Please notify AACT within 2 business days of initial booking date if any omissions and/or corrections are needed regarding the booking details or special requests, for any aspect of your vacation. Passenger(s) voluntarily assumes full & sole responsibility for any and all risks and/or costs involved with failure to report such errors and/or omissions within the required time. Passenger is required to verify the accuracy of each passenger's LEGAL first & last names. It is mandatory that guest names be identical to the Passenger(s) LEGAL first and last names and identical to the names as they appear on booking and travel documents such as passports, driver licenses and birth certificates.
AIRPORT/PIER IDENTIFICATION & PROOF OF CITIZENSHIP: A valid passport is required for all international travel with the possible exception of a Caribbean cruise, where a valid government issued I.D and a CERTIFIED copy of a birth certificate may be acceptable. Domestic air transportation requires identification by a government issued document i.e. a driver's license.
If your booking includes a cruise, all passengers will be required to complete online pre-registration information, if applicable, to your cruise line, as well as present all required documentation at the port on embarkation/sailing day. YOU MUST COMPLETE THE CRUISELINE REGISTRATION FORM – AS SOON AS POSSIBLE! Failure to do so will delay your cruise documents and you may possibly be denied boarding your cruise ship on embarkation day! Once completed on-line, we recommend you print out a copy of the completed form for your records and possible presentation at the pier on embarkation day.
Passports and Visas: Passengers are responsible for ensuring that they have the proper travel documents and MUST CHECK with the respective consulate(s) or visa agency to determine whether any visas or passports are required. Passports are required to be valid for at least 6 months beyond the dates of travel. Some countries require a full blank page in the passport for stamping purposes.
Passenger(s) assumes sole responsibility to independently confirm all documentation requirements for all passport, visa, vaccination, or other entry and/or travel requirements of each destination. This includes but is not limited to: passage to all foreign countries, ports of call, on board ship, for any applicable air transport, entering/exiting a country, and all safety and security conditions of such destinations, during the length of the proposed travel. Passenger(s) assumes sole responsibility for, and hereby releases AACT from any claims or responsibility for any and all damages incurred as a result of Passenger(s) failure to comply with applicable documentation requirements, including but not limited the requirement that all Passengers procure, and have on their person the proper travel documents at all times. AACT is not required to inform Passenger(s) of the necessary documents. AACT recommends the Passenger(s) consult with the appropriate domestic and foreign governmental agencies for the current document requirements.

PAYMENTS: ALL payments are conditional to acceptance by travel suppliers, approval for which may take up to 48 hours after AACT provided the payment to the vendor. We will attempt to contact you immediately if we receive information that your payment was not accepted. You voluntarily accept and acknowledge, without limitation, that AACT is not responsible for any cancellations of travel services that result, AT ANY TIME, from a declined credit card payment. You also agree and acknowledge that AACT shall not be responsible for any damages or claims arising from errors related to the electronic processing of credit card payments. Payments are securely transmitted to the vendor for direct charging by the vendor. Payments may take up to 3 business days to be posted to your credit card account.
Payment of Tour components (including airfare) of your booking may be charged separately, direct by AACT and will be made under the name: Vacation Superstore Network, Inc. or Anchors Away Cruises. Please note this, as it may avoid a possible charge-back misunderstanding.
Failure to remit payments in a timely manner will automatically put your booking at risk of cancellation. Please contact us immediately, in advance of your final payment due date, if you will be unable to meet this obligation. Without limitation, Passenger(s) voluntarily hold AACT harmless for cruise line and supplier cancellation of any booking for either late payment or declination of a credit card. LATE PAYMENTS ARE SUBJECT TO A $35 FEE by AACT.
THIRD PARTY CREDIT CARD CHARGES: If the credit card holder is purchasing a cruise for any cabin they are NOT occupying – then the credit card holder MUST complete a Third Party Credit Card Authorization Form. A photocopy of the Passenger's driver's license with the credit card present at time of booking is required. If booking is by phone, a photocopy of the Passenger's credit card is also required. The credit card holder voluntarily accepts all terms and conditions of this contract and those of the applicable travel supplier(s) for this booking. Failure to complete this form and return it to us immediately may result in cancellation of your cruise (penalties apply).
PRICING: Prices featured in PRINT ADVERTISING or ONLINE in the AACT booking/quote engine are not final, and may change until the Supplier/cruise line selected for travel has successfully processed the initial payment for your booking. Passenger agrees that AACT is not responsible for any errors or omissions in any advertisements, including on our website, resulting in inventory, content, or pricing discrepancies nor is AACT responsible for any errors or omissions that may occur as a result of incorrect information from third parties. Cruise Lines and other suppliers reserve the right not to honor any published prices that it determines were erroneous due to electronic, printing, or clerical error. You acknowledge this right and agree to hold AACT harmless for any actions or damages arising from Cruise Line pricing.
If the cruise line lowers the cost of your cruise, rate adjustments may be available upon request until your final payment due date. Rate adjustments are not available after your final payment or final payment due date, whichever comes first. The lower rate must be available for booking at the time you contact us in person or by phone, as determined by our travel advisors, and you must qualify for the rate. Since pricing and availability are always changing, AACT cannot accept voice mail, emails, faxes or screenshots or other purported evidence of a lower price. If the cruise line determines that a rate adjustment is applicable, your FIRST rate adjustment is exempt from any rate adjustment change fee. However, each subsequent rate adjustment, if applicable, will be assessed a $25 per booking rate adjustment, per occurrence.
Passenger(s) understand and acknowledge that if a rate adjustment is available, many cruise lines will provide on-board credits or a similar benefit in lieu of a cash discount. Free/reduced price value added gifts or earned club points to order such items (travel protection, wine packages, robes, shopping booklets, future hotel stays, etc.) will be affected by price reductions. Accordingly, price adjustments allowed by the cruise line may not be allowed due to the value added benefits included with your booking. You acknowledge and voluntarily accept that AACT reserves this right.
AACT reserves the right to charge Passenger(s) for any increase in taxes, fees or surcharges (i.e. fuel). Passenger(s) acknowledge this right and agree to pay any such additional taxes, fees, and surcharge.
AIR FARE: AACT reserves the right to choose for each passenger: the air carrier, routing, flight times, and airport from each gateway city. Flight information is provided approximately 15 days prior to your departure date. Please note that if seats are not assigned or you wish to change air seats, you will be required to call the airline directly. If you wish to control any details of your air flights, we STRONGLY recommend that you request an airfare deviation at an additional cost to you, the Passenger(s). Please contact us for further details regarding this option.
Passenger(s) agreed to waive and hold harmless AACT for any damages or claims resulting directly or indirectly from any air transportation related accidents, incidents, damages, baggage losses and/or delays, regardless of whether the incident is due to third party negligence, strikes, weather, acts of God, acts of governments or authorities, wars, terrorism, criminal acts committed by third parties, hostilities, civil disturbances, riots, pilferage, defects of vehicles or breakdown in equipment, or to the fault or default of any air carrier.
HOTELS: Passenger(s) agree and accept that hotel star categorization is not standardized and is a subjective determination that can vary tremendously. All hotels are chosen on best practices of AACT determination of acceptable quality. Such quality is based on many factors including said star (2-star, 3-star, 4-star etc.) designations, as well as average review quantifications of leading hotel and travel sites possibly including but not limited to, Trip Advisor, Hotels.com/Expedia Group and Booking.com Group. In our advertising material, AACT will publish links to a specific hotel that meets our qualifications. AACT includes a disclaimer of (subject to change) for the named hotel as circumstances may arise that AACT determines another hotel will be a better choice. In this case the named hotel and the hotel selected will be of similar quality.
AACT does not include, and is not responsible for, any Hotel/Resort fees, local taxes or fees collected upon checkout.
In Foreign countries, the standard US designations on Twin, Double, Queen, King size bedding varies. AACT will make every effort to provide the largest bedding available in the standard category of the selected hotel. You hereby accept and acknowledge that a Double Room designation in a foreign country hotel may actually be a US sized Double bed or Queen bed. If you require a specific type of bedding based on US standards, you accept that it is your responsibility to advise your travel advisor of this requirement. Your travel advisor will determine if your request can be fulfilled and if there is an additional charge.
PASSENGER / NAME CORRECTIONS: Name correction requests (including incorrect legal names, misspellings) are at the discretion of AACT and Passenger(s) agree that AACT is not responsible for any delays, cancellations, charges or penalties associated with and name change requests. All name correction requests at anytime (except within 3 business days of initial booking date) are subject to a $35.00 fee per person, per occurrence, imposed by AACT. As stated previously, these fees are IN ADDITION TO any travel supplier (cruise, air etc.) imposed fees. All name changes MUST be submitted in writing to AACT WITH ALL REQUIRED SIGNATURES to process. Please contact us immediately if you have any questions regarding this procedure.
CHANGE IN ITINERARY: Cruise lines and other travel Carriers/Suppliers reserve the right to change itineraries and other aspects of your booking (i.e. Hotel, tours etc.) at any time. When practical, the cruise line and subsequently AACT will make reasonable attempts to notify you of material pre-cruise itinerary changes including changes in a port of call or arrival and/or departure time by 2 hours or greater. Complete cruise line policies regarding itinerary changes can be found on the cruise line's website or in the cruise brochure(s). Passenger(s) agree that AACT shall not be responsible for any damages or claims resulting from any change in itinerary by a cruise line or supplier.
CABIN CHANGES & GUARANTEES: Your first cabin change is exempt from any change fees imposed by AACT. All subsequent cabin changes that do not result in an increase in cruise fare actually paid by the Passenger(s) are subject to a $50 per occurrence change fee imposed by AACT in addition to any fees that may be imposed by the cruise line. Passenger(s) are responsible for any additional cruise fare as a result of a cabin change. Since pricing and availability are always changing, AACT cannot accept screenshots or other purported evidence of available cabins or categories.
Please note that if you have chosen a cabin on a "guarantee" basis it will be indicated on your confirmation letter as "unassigned" "run-of-ship" "ros" "guarantee" or "gty". A cabin guarantee is a reservation for at least that category or better. AACT and its booking agents cannot guarantee that you will attain a cabin better than the minimum category guarantee. Final assignments of "guarantees" may be at the time of documentation OR ultimately at the pier on day of embarkation. Additionally, if you have chosen a guarantee – please be advised that in bookings consisting of 3-5 people sharing the same cabin, that the cruise line reserves the right to utilize a rollaway to accommodate a third, fourth, or fifth passenger in a cabin. Handicap cabins booked by non-handicapped persons may be re-assigned by the Cruise Line at any time, based on needs. Passenger(s) agree that AACT shall not be responsible for any damages or claims resulting from any cabin assignments by a cruise line.
All payments are 100% non-refundable.
All cancellations MUST be in writing and SIGNATURES OF ALL TRAVELING PASSENGERS ARE REQUIRED to properly process.
Please call us for a cancellation form. Once complete, the cancellation form must be printed out and hand delivered to AACT OR faxed to us at 815-461-3876. Faxing to any other fax number will not be accepted as a valid change. Cancellations will not be processed until we have received a properly completed & SIGNED authorization. This procedure must be followed in order to accurately and expeditiously cancel a booking upon your request. Your cancellation will be confirmed via email when processed. Please contact us immediately if you have not received a cancellation confirmation within 1 business day of delivering, or if you have any questions regarding this procedure.
You acknowledge that vendors may refund payments back to your credit card and accept that the AACT cancellation policy entitles AACT to all credits issued back to you from vendors and agree to reimburse AACT for these credits. These credits may be claimed on any travel protection claim you make.
TRAVEL PROTECTION: Standard Travel protection is strongly recommended and included on all Golden Anchor Tours except motor coach only tours. AACT suggests Cancellation & Medical protection and such coverage is an important purchase decision regarding your vacation travel. As your travel advisor, we have a professional responsibility to recommend the purchase of travel protection to protect both you and your vacation. AACT's sole responsibility is to advise the passenger(s) to take travel protection. The selection of an insurance carrier is the single responsibility of the customer. More detailed information is available directly from the insurance company at 1-866-684-0218.
By declining the Cancel for Any Reason travel protection UPGRADE, you acknowledge and accept liability for any cancellation penalties, damages and/or out-of-pocket expenses incurred that the standard policy does not cover. We urge you to read your policy when it arrives as it contains important information. This information includes, but is not limited to, details on the extent of coverage and procedures for making a claim.
All requests for service under the policy must be filed directly with the Travel Insurance Company, in accordance with the policy terms and conditions, which you the passenger are responsible for reviewing upon receipt of your travel protection policy. AACT is not able to give advice with regard to possible cancellations and any associated claims processing. All queries regarding cruise cancellation, penalties, coverage should be directed to your particular Travel Insurance Company. If you purchased a policy through Travel Insured International, they can be reached at 1-866-684-0218 for policy questions or to request Emergency Travel Assistance or to file a claim, please call 1-888-268-2824 (outside of North America call 01-603-328-1725). Please note that the Travel Insurance Company is not allowed to discuss your claim with AACT due to privacy laws (e.g. HIPAA). Accordingly, you acknowledge that AACT cannot be involved in any aspect of your claim/request for service. Please note that AACT's cancellation fees are not a reimbursable expense under Travel Insured policies. Passenger(s) acknowledge and agree that AACT has no control over the Travel Insurance Company or its coverage decisions, and as a result AACT is not responsible for and shall not be liable for policy coverage, claims processing, or the denial of any claims.
AGENT/INTERMEDIARY: AACT is simply an intermediary between the Cruise Lines/Suppliers and the public. AACT does not own or operate any of cruise lines, vessels, flights, hotels, shore excursions, tours, transportation providers, travel protection companies, attractions, or other travel-related suppliers who provide goods or services for the Passenger(s)' trip. Passenger(s) acknowledge and agree that AACT shall not be responsible for any loss, damage, delay, inconvenience or injury to Passenger(s) or group members as a result of a breach of contract, act or omission whether willful or negligent, criminal or otherwise of any person other than AACT or its direct employees, including but not limited to these suppliers, their employees, agents, servants, or representatives.
Cruise Lines, hotels, airlines, shore excursion companies, transfer companies, motor coach companies etc. (Suppliers) reserve the right to deviate from the direct, customary and/or scheduled route or itinerary for any reason, without limitation and without notice.. Passenger(s) acknowledge and agree that AACT is not responsible for Supplier deviations, delays, cancellations, mandated overnight stays, missed connections or any other condition beyond its control. AACT is not liable for any loss due to Passenger's gambling and is not responsible for any purchases made while on the trip including services or products purchased while on shore excursion, auxiliary trips, tours, etc.
AACT recommends that all Passengers be in good physical and mental health and have medical approval to travel. Any physical disabilities must be reported to AACT at the time of reservation and IN WRITING within 24 hours of initial booking so AACT can contact the Cruise Line and Suppliers to investigate amenities and/or special accommodations offered. Passenger is required to provide his or her own personal or individually prescribed devices such as wheelchairs, walkers, or similar devices. If more than minor assistance is needed, Cruise Lines usually require that the Passenger be accompanied by a companion who is capable of, and responsible for, providing such assistance. Cruise Lines and other Suppliers often reserve the right to reject Passengers whose mental or physical condition may interfere with the itinerary. Suppliers reserve the right to refuse or revoke passage to Passengers who, in their judgment, may be refused admission into a port or landing or into the country of destination. Passenger(s) acknowledge and agree that AACT shall be held harmless for any and all claims relating to Cruise Line or Supplier rejection relating to mental or physical condition.
No undertaking, guarantee or warranty is given or shall be implied as to the fitness or condition of the Supplier's accommodations, transportation, or any food, drink, medicine, or provisions supplied. Without limitation, AACT is not responsible for cruise conditions, or quality of accommodations. Passenger(s) acknowledge and agree that AACT shall not be responsible for refunding, either fully or partially, any amounts paid due to unsatisfactory services from any supplier. In no event shall AACT be liable for any accident which occurs ashore, on board ship, on tenders, on shore excursions, in hotels, in resorts, on airplanes/in airports, on buses/in bus stations, on trains/in train stations, or during any mode of transportation encountered during the trip, resulting from equipment or any other cause. The Passenger admits a full understanding of the nature and character of the mode of transport and assumes all risks of travel, transportation and handling of passengers and baggage.
Without limitation, Passenger(s) assume the risk of, and agree that AACT is not liable for any damages arising from or related to any act of God or public enemies, arrest, restraints of any government or rulers of people, piracy, war, revolution, extortion, terrorist activity, threatened or actual rebellion, political upheaval, civil unrest, riots, fire, lockouts, explosion, collision, weather conditions, dangers incident to the sea, mechanical or construction failures or difficulties, diseases, local laws, abnormal conditions or developments, closure of airports/seaports/hotels/train stations, carrier or supplier logistical problems, computer problems stranding, food or water poisoning, illness, grounding, perils of the sea, rivers, canals, locks or other waters, perils of navigation of any kind, lack of water or passageway in canals, theft, accident to or from machinery, boilers, or latent defects even though existing at embarkation or commencement of the travel package, desertion or revolt of crew, or lost/damaged/delayed luggage.
MANDATORY ARBITRATION / FORUM / CHOICE OF LAW: The Parties hereby agree that any and all disputes arising out of or relating to this Agreement shall be submitted to final binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association and shall be governed by the laws of the State of Florida. The Parties agree that the arbitration shall take place in St. Lucie County, Florida and will be conducted by a single mutually agreed upon arbitrator. The arbitrator shall permit both sides to conduct reasonable discovery, in her/his sole discretion, and shall render a written award. Payment of the cost of the arbitration, including the arbitrator's fees and room rental, shall be split equally between the Parties. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
The Parties acknowledge and agree that this arbitration is their sole recourse and that they may not file a lawsuit against AACT. If Passenger(s) fails to submit their claim to arbitration and instead files suit, AACT shall be entitled to recover its attorney's fees and other costs incurred in the enforcement of the terms of this Agreement, including costs incurred seeking referral to arbitration. Passenger(s) and AACT agree that neither party shall be entitled to join or consolidate claims or arbitrate any claim as a representative or class action.
